On Monday, U.S. District Judge Aileen Cannon dismissed the classified documents case against former President Donald Trump. She ruled that the case could not proceed because the appointment of special counsel Jack Smith was unconstitutional.

“The Superseding Indictment is DISMISSED because Special Counsel Smith’s appointment violates the Appointments Clause of the United States Constitution,” wrote Judge Cannon, who Trump appointed. Special counsel Jack Smith had opposed this argument, and other federal courts had previously upheld the constitutionality of special counsels.
